Biznuke is an application which provides an online networking platform where online reselling business community (Suppliers, Resellers & End buyers) can connect with each other to sell-resell-buy products and perform online reselling activities with more ease and seamless manner. It is an Android based mobile application where registered “Suppliers” can sell their listed products to “Buyers” through a chain of “Online Resellers”.
The Application and the website at www.biznuke.in (“Website”) (hence forth collectively termed as the “Platform”) are operated by Biznuke (OPC) Private Limited (including its directors, full time employees, subsidiaries and affiliates, hence forth collectively termed as, the “Company”).
By installing, downloading or even visiting or accessing any part of the Application or utilising the Services and accessing the Website, users, including without limitation users who are browsers, Suppliers, Resellers, merchants, or contributors of content (collectively, “User”) agree to be bound by the Terms of Use (“Terms”) contained in this document.
IF THE USER DOES NOT AGREE WITH THESE TERMS, THE USER IS ADVISED TO REFRAIN FROM USING THE PLATFORM. BY ACCESSING OR USING THE PLATFORM, THE USER IRREVOCABLY ACCEPTS THE AGREEMENT AND AGREES TO ABIDE BY THE SAME (AS UPDATED FROM TIME TO TIME).
Biznuke application is made to simplify the way online reselling is done today. It works on similar principles as of done through today’s WhatsApp groups but provides a dedicated platform where user don’t need to rely on social media platforms. By doing this, Biznuke try to resolve issues that online Supplier/ dealers and Resellers face in their day-to-day business activities, such as heavy media downloads and related device issues, customer fishing/theft, dependency on social media apps, complex communication etc. to name a few.
With this new platform
Biznuke works on invite based model. That means, the app access will be available through invite links shared by registered Suppliers/ Dealers to their Resellers and further by Resellers to the end buyers.
Thus, the Biznuke App is nothing but;
The Application assists Users (“Suppliers/ Dealers”) to share/ promote the products to potential “Buyers” through a chain of one or more middle persons called “Resellers”. In turn, the “Buyers” can buy the products displayed by “Sellers” and re-shared by “Resellers” by making payments through third party payment gateways. To do so, “Buyers” pays to respective “Resellers” or “Suppliers” directly through a digital wallet mechanism build by the company. While such payments against any product purchase or order confirmation are made, the company has no financial share in such transactions.
The Company, subject to the terms and conditions set out herein, helps its registered users to network with other registered users and exchange product details etc, exchange business dialogs and facilitate the placement of orders for the products.
While using Biznuke application, one should understand that;
The Company does not own, sell, resell products on its own and/or does not control the Suppliers/ Resellers. Below mentioned steps are considered as an ideal use of Biznuke platform.
The Company is not responsible for any inaccuracy, incompleteness or outdated information made available on the Application, either provided by the Users or the Suppliers. The material on the Application is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. The Users agree that, the Company does not own any responsibility or obligation whatsoever towards either ensuring the accuracy of the information provided by the Users. Any reliance on the material on the Application is at the Users’ own risk.
The Company reserves the right to delist any product from the Application.
The user understands that as the company is only providing a platform where Users get to network with each other and Company is not involved in actual selling, marketing or promoting of any Sellers or their products neither they are involved shipment and related activities of such products. Hence Company is not responsible for the quality of products, any deviation in described vs received product after purchase or any damages happened during the shipping of the product. User is sole responsible for any communication or transactions that he/ she is making with other User in terms of communication, messaging, image sharing or even payment transactions. Company is not bound to return, replace products or make refund against any transactions.
All commercial/contractual terms are offered by and agreed to between Suppliers/ Reseller as a User and the Buyer as other Users alone. The commercial/contractual terms include without limitation, price, shipping costs, payment methods, payment terms, date, period and mode of delivery, warranties related to products, etc. The Company does not have any control or does not determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between the Suppliers/ Resellers and the Buyers. All discounts and offers, if any, are by the Suppliers and not by the Company.
The Users understand, accept and agree that the payment facility provided by the Company is neither a banking nor financial service but is merely a facilitator providing a third-party payment processor for the transactions on the Application. Further, by providing payment facility, the Company is neither acting as a trustee nor acting in a fiduciary capacity with respect to the transaction or the transaction price. The Company will not be liable for any charges made by the Users bank or any other third-party payment agencies in relation to payment of the total amount.
The Users agree to provide current, complete and accurate UPI transaction IDs and other details such as Bank account information, Credit card information etc during registration for streamlining payment process to place an order with concerned user.
The Company is not responsible for the earnings made by the Users by selling- Reselling products using Biznuke Platform, neither is responsible for depositing any taxes and creating, providing any related documentation by such Users.
Although guest users can have access to Biznuke web portal but the Biznuke mobile application is only available to its registered users. Supplier/Reseller Users has to register with Company to avail access to the download, install and use the application.
To become a registered user, suppliers have to first register with Biznuke through ‘Register’ form on company web portal. The access to the Biznuke App will be provided to those suppliers after user validation carried out by company.
Registered suppliers are permitted to upload and share products details for sale on the Platform in accordance with the Terms and Policies which are incorporated by way of reference in this Terms of Service. The Suppliers accepts the responsibility to validate that while sharing such product information they are not infringe upon the intellectual property, trade secret or other proprietary rights or rights of publicity or privacy rights of third parties. The Suppliers and the Users agree that the Company is not responsible and liable for any such information uploaded/ shared by Users.
The register suppliers can share the invite to follow their shop to one or multiple resellers. Resellers, if first time users, have to complete the registration formalities to start accessing and using the app.
The registered resellers can create their own shop and resell the supplier’s products by adding the margin amount as their income.
Once the product is liked by a potential Buyer, He/ She has to first make payment to concerned Reseller or Supplier through third party payment gateways (e.g. Google Pay, Phone Pay, Paytm etc.). Order is considered as confirmed only once the payment is done and no COD option is available.
The Users (Buyer in this case) understand that any order that they place and the payments/ money transaction they make for that cause, is User’s sole decision and judgement that is taken by closely examining the Seller, Reseller and product information shared by Supplier or Reseller.
Any transactions/ payments made by the end buyer will be reflected in the Supplier/ Reseller’s digital wallet as ‘Outstanding Balance’. This ‘Outstanding Balance’ is converted to ‘Current/ Actual Balance’ once the respective supplier dispatches the product and mark it in Application as ‘Dispatched’.
Users can withdraw the amount in ‘Current/ Actual Balance’ to their respective personal accounts once the balances reach beyond INR 100. For any such withdrawal there should be minimum INR 100 collected in ‘Current Balance’. *Specific charges per withdrawal may apply.
On receipt of an order from a Buyer, the respective user, Reseller or Supplier shall receive a notification or electronically a confirmation of such order.
On receipt of new order, Supplier has to pack and ship the respective product to the concerned Buyer user. The Supplier is sole responsible for packaging and shipment of the received orders.
In case, the End Buyer/ Customer opts for return of any product he/ she has received against his/ her order placed; they can do it using the platform’s ‘Request for return’ feature.
In such situation End Buyer/ Customer has to share the unboxing video and or supporting images of the same product with the Seller/ Reseller through the platform.
The Seller and Reseller have final rights to take appropriate decision to whether accept or reject such return requests based on examining the supported video/ images shared by end buyer. If Seller/ Reseller accepts the return request, End Buyer has to ship the product back to the seller on mentioned return shipment address. The cost for returned shipping can be paid by either End Buyer/ Customer, or by Seller or Reseller. This can be decided between the respective Seller-Reseller-Customer users.
The Seller will make the refund either after receiving the return product dispatch details (courier & tracking ID) or after receiving the parcel.
The returned amount will be deposited to End Buyer/ Customer’s wallet which he/ she can utilize for other purchases or can withdraw to their bank accounts.
Pls note; Biznuke is not entitled for assuring the acceptance of return requests by Supplier/ Resellers. Any such decisions are of their own and made exclusively based on examining the support video/ images. At the same time, Biznuke will not responsible answerable to any to return requests, its acceptance or rejection and the refunds related issues.
The Company is not responsible to any equipment, software, data or other property for damage or viruses affect as a result of downloading and installing the Application.
The Suppliers shall be solely responsible for the details pertaining to specifics (such as quality, value, saleability, etc) of the products proposed to be sold or offered to be sold or purchased on the Application. The Company is not responsible for damages or delays of products. The Company does not implicitly or explicitly support or endorse the sale or purchase of any products nor provide any warranty/guarantee of the products sold to the Users, and in no event shall such products be the responsibility of the Company.
The Company is not responsible for any non-performance or breach of any contract entered into between the Suppliers- Resellers and the Buyers. The Company cannot and does not guarantee that the concerned Suppliers will perform any transaction concluded on the Application. The Company shall not and is not required to mediate or resolve any dispute or disagreement between the Users concerned.
The Company only provides a platform for communication and it is agreed that the contract for the sale of any of the products shall be a contract between the Suppliers- Resellers and the Buyers concerned.
The Company shall not be liable for any misuse of the information shared by the Users with it; or through the Users profile; or with a third party on the Platform, chat rooms, forums, or comments.
The Application may be under constant upgrades, and some functions and features may not be fully operational.
The Users shall be solely responsible for damages to their data system or for loss of data arising from the download of content from the Application.
The Company reserves the right in its sole discretion to remove any material/content/photos/offers displayed on the Platform.
The Company is not always guarantied that:
The Company reserves the right to terminate the Users account and / or deny access to the Platform if it is brought to the Company’s notice or if is discovered that the User does not meet the conditions herein.
The Company reserves the right to delist any product from the Application.
The Company reserves the right to change, modify, amend or update these Terms and/ or the Agreement from time to time and such changes in these Terms and/ or the Agreement shall be effective immediately upon being posted on the Platform. If the Users do not agree with such provisions, the Users should stop using the Platform with immediate effect. In case the Users’ continued use of the Platform will be deemed to signify their acceptance of the changes of these Terms and/ or the Agreement.
